Kevin Evans accepts doping charge

Cycling South Africa reports that the South African Institute for Drug-Free Sport (SAIDS) has charged mountain bike cyclist, Kevin Evans with doping after identifying serious irregularities in his Athlete Biological Passport (ABP) – a profile of the athlete’s blood parameters.

Mr. Evans accepted the charge of doping and did not contest the findings. The ABP is a longitudinal analysis and the suspicious readings were identified over a period of time, therefore the athlete’s results extending back to 14 March 2014 will be disqualified, with all of the resulting consequences, including forfeiture of any medals, points and prizes.

He will be banned from sport for four years as of 4 March 2015 until 3 March 2019. The athlete has however indicated that he has retired from professional cycling.

Cycling South Africa respects the independence of the SAIDS process. Cycling South Africa further reiterates its zero-tolerance approach to doping in sport and will continue working with SAIDS in the promotion of a drug-free sport via its awareness and extensive testing programmes.

Perhaps you could point out one or two specific examples within this thread? I don't know anyone in this thread personally so it's not possible for me to assess behaviour against stated claims. Maybe you do know some of the people and can therefore accurately label them as hypocrites.

And we wait with baited breath......

Criminalising drugs in sport in SA? How? The Drugs Act seems to be more about stopping dependency-inducing drugs, so PEDs don't really fit in there. Medicine scheduling seems to be about who can sell or prescribe drugs.

 

Would the "Hansie clause" in the corrupt practices act apply to doping? If so, nearly all the cyclists and commentators who have said they knew Evans has been doping for years could face possible prosecution...

One of the tragedies in this case is something like the Cape Epic.

Kevin will not be allowed to be involved with anything Cape Epic in the future. He could have made a killing being a team manager, or he could have given some of his or the event sponsors some good race exposure participating non-competitively (I think back on Mannie on his fatbike, what a treat!).

 

Instead he now can only watch from the side lines and the event cannot call on him to do any promotion of the event now that his reputation is tainted with doping.

This picture seems so ironic in many ways. It was posted on Kevin's Instagram account the same time Rourke was caught and being pressured by authorities. 1st person to reply is Rourkes dad saying Rourke basically agrees and he will keep his mouth shut. He has to this day it seems.

 

Amazing how Brandon Stewart and the rest of the "pack" come to Kevin's support when Darren has the balls to voice his opinion.

 

When reading Darren Lill's posts, you cant help feeling sorry about the abuse he got in this post alone but now he has to be smiling inside.

 

Shame on you.

No, all the events need to follow the epic' example. It's good for the sport. I'm afraid that if you buy the ticket, you take the ride.

I think one of the elements of fraud is missing. Currently the act of taking PEDs is not illegal in South Africa (so it seems). One of the key elements of fraud is that the act must be unlawful. The others all seem to get a tick though...

 

From Justanswer.com:

 

The following elements are required to be proved. Depending on whether you are dealing with a criminal case or a civil matter, the onus of proof will either be above reasonable doubt (criminal) or on a balance of probabilities (civil)
1. An act by the person concerned;
2. Committed unlawfully;
3. With the intention to mislead another person;
4. That causes the other person to act differently to what he would have acted, but for the fraud; and
5. Only in the case of a civil claim, the claimant must have suffered harm or loss as a result of the fraud.

Maybe this is why the authorities/sponsors don't take these matters to court in South Africa?

Sponsors could take dopers to court if they signed a no-doping agreement. But those would be civil cases not criminal.

Couple this very professional behavior with the lingering doping cloud and it's frankly amazing we have any pro cyclists at all...

Seems that in SA law as it stands a person would have had to have been offered something as a gratification that led to them to dope to influence the outcome of a race.

Interesting to see the Chemical Brothers and their groupies attacking Darren like that on Instagram. They should all be ashamed of themselves. Sadly, I don't think shame is something that comes easily to any of them.

Thing is, it's pretty hard to fix the outcome of a cycling race. Doping seems like it would be more a sort of attempted fraud rather than an actual fraud.

 

Ask Vino how hard it is. How much did he pay the rider in the Olympic road race again? Very talented, negotiated the deal on the bike on the way to the line.
