Kevin Evans accepts doping charge

Cycling South Africa reports that the South African Institute for Drug-Free Sport (SAIDS) has charged mountain bike cyclist, Kevin Evans with doping after identifying serious irregularities in his Athlete Biological Passport (ABP) – a profile of the athlete’s blood parameters.

Mr. Evans accepted the charge of doping and did not contest the findings. The ABP is a longitudinal analysis and the suspicious readings were identified over a period of time, therefore the athlete’s results extending back to 14 March 2014 will be disqualified, with all of the resulting consequences, including forfeiture of any medals, points and prizes.

He will be banned from sport for four years as of 4 March 2015 until 3 March 2019. The athlete has however indicated that he has retired from professional cycling.

Cycling South Africa respects the independence of the SAIDS process. Cycling South Africa further reiterates its zero-tolerance approach to doping in sport and will continue working with SAIDS in the promotion of a drug-free sport via its awareness and extensive testing programmes.

It was unlawful in that it was a libelous statement, when applying the reasonable man test. Your post inferred KE. There's no other person it could have been, based on previous doping convictions. 

Actually, whether or not it was lawful unlawful or otherwise (cf Schrodinger's cat) remains untested....

if someone came out on twitter blatantly calling me a doper (not even vague inferrences), I'd just laugh it off and wouldnt even give them the time of day.

 

KE/BS on the other hand....

Imagine if Froome sent an Emma letter to everybody who directly calls him a doper, never mind inferring it.... Emma would be rich!!

This yes...and that would be my response too...I have heard many rumours in the past few weeks...not having been in cycling all that long and not knowing all this stuff all that well...I sat back and I was a bit horrified....but I am not going to go on twitter or sit here on The Hub and start throwing names around.....

Us poor schmucks who have been in this sport since we could crawl tend to have a fairly accurate idea of what goes on. And let me tell you something, it is the cynics, the skeptics, that Lance feels sorry for, who just keep getting proved right. So annoying, but there you are.

well you could always try raise awareness that certain cyclists are known dopers on twitter and see how far it gets you

I agree with you fully....but it's a heck of a risk won't you agree....putting to your sweaty Planters on the block without any hard cold facts....

Why do you say it's unlawful? He made a simple observation. Nothing untrue in his observation.

 

So, theres a SA pro, who, since his partner got busted for EPO in 2012, suddenly hasn’t been performing. Make me wonder...” 

 

There might have been a perfectly valid reason for the drop in performance which KE could have explained (or he could have just ignored the tweet)

 

In hindsight the response to that tweet is far more telling than the "veiled" accusation in the tweet

Uncontested. 

No, untested. On the basis of it not being tested, nobody can make a claim as to the statement's status in law unless it is tested by the law. That it is uncontested means just that it will not be tested and therefore claiming it is lawful or unlawful is entirely mooooooot.

Fair comment – This defence differs from the truth defence in that the basis of this defence is the fact that a comment or opinion exists. This defence therefore protects the right of a citizen to honestly express his genuine opinion

This is why testing the statement could have proved interesting. However, had I been slapped with a lawyer's letter, which it must be said, is nothing more than a lawyer's letter, I too would have gone, 'ah stuff it' and deleted a few tweets and carried on with my life. Would middle class folk in SA really get a couple hundy thousand rondt together to klap handbags at dawn over something like that? Not a freakin chance, most are too sensible and know better than to engage in something financially draining and which will deliver scant reward beyond a hearty 'I told you so'. The gamble is worth it for the dodgy operator though...it is a game of chicken, if you blink first and fast, guess what, everyone wins. Unless you are DIRECTLY interested in some good old vengeance, it just isn't worth it.

You okes who have had divorces should know full well what it means to get The Law involved. Proves PDQ that it is not an ass, it is an EXPENSIVE ass. And nobody likes that kind of ass...

The simple question here Fandacious...at the time of you making that comment...what were your intentions....even though you did not mention a name...you could not have made it any easier except for spelling it out....and you put your sweaty Planters on a block because of "stories" ....I don't really need the answers to these....and bear in mind...guys lke me knew nothing about the Emma letter till you mentioned it...and to be very honest and I hope you don't take this as an insult....it did come across as a little moan....you have bigger cream carriers than me and I will concede to that....I would definitely not have the guts to take a comment public unless I have facts......

Honestly don't know why I keep coming back to this thread... So over it all. Just have him pay back whatever ill-gotten monies his won, nullify his results and let him fade into obscurity.
